Proposed Sandhills wind farm disputes zoning findings of permit violation

KILGORE, Neb. — The company behind a proposed wind farm near Kilgore is challenging a Cherry County zoning investigation that concluded its permit had expired and that multiple conditions had gone unmet.
BSH Kilgore filed an appeal of the zoning administrator’s findings with the Board of Adjustment on July 21. The board is scheduled to meet Aug. 18 to set a date for a hearing on the complaint.
The company also sent a formal response to the Cherry County Commissioners on Aug. 7, following the board’s request.
BSH Kilgore received a conditional use permit in 2019 for a wind energy project about 25 miles west of Valentine. The project has since faced legal challenges and, more recently, a zoning complaint.
Cherry County Zoning Administrator Jane Stolzenburg determined the permit expired Oct. 15, 2024, and that BSH Kilgore had not met all 12 conditions tied to the project. Commissioners gave the company 30 days to respond to the investigation’s findings.
