PIERRE, S.D. - A South Dakota Division of Criminal Investigation (DCI) review has determined that an Oglala Sioux Tribe Department of Public Safety officer was justified in using force during a high-speed pursuit on May 2 in Fall River County, according to Attorney General Marty Jackley.

As News Channel Nebraska previously reported, Cody Dittman of Norfolk is accused of leading authorities on a chase topping 100 miles per hour after officers attempted to stop him in connection to a firearms-related call in Pine Ridge.

Two tribal officers deployed spike strips along Highway 18 and were standing in the north ditch when the review says Dittman’s vehicle veered off the road, heading straight toward them. One officer fired three rounds at the vehicle, striking a front-seat passenger in the arm.

The chase continued into Nebraska, where the vehicle eventually came to a stop. Dittman fled on foot, while the two passengers stayed behind. He was captured five days later in Pine Ridge.

The injured passenger was treated for non-life-threatening injuries. No officers were harmed. The officer who fired the shots tested negative for alcohol and illegal drugs, Jackley said.

Dittman faces multiple charges in South Dakota, including Felony Aggravated Assault Against a Law Enforcement Officer and Felony Aggravated Eluding. He also faces federal charges in Nebraska.

The DCI investigation was conducted in collaboration with the FBI’s Rapid City Field Office.
