Norfolk city council member arrested on enhanced DUI charge

Police say he was stopped after driving the wrong way on a one-way street

NORFOLK, Neb. — A Norfolk business owner and Ward 4 city council member was arrested early Wednesday on suspicion of enhanced, first-offense driving under the influence, according to police.

The Norfolk Police Department said an officer noticed a gray pickup truck traveling the wrong way on a one-way street in the 200 block of South Fifth Street around 1:28 a.m.

A traffic stop was conducted in the 100 block of South Third Street. Officers reported observing signs of impairment and detecting the odor of alcohol. Police say McCarthy failed field sobriety tests.

Andrew K. McCarthy, 40, was arrested and transported to the Norfolk City Jail. He was later released on bond.

Online court records do not yet indicate whether an initial court date has been set.

McCarthy released a statement on social media:

City of Norfolk,

On Tuesday night, I was pulled over and detained for a DUI. The mistake I made will have a positive impact on me, I will refuse to be knocked down by this.

However, I have decided not to run for a 3rd term as the Ward 4 City Council representative for the city of Norfolk. This will allow me to have more time that I have not had for the last few years. More time with my family and more time for my businesses and give my amazing staff the support they need.

I am truly sorry for any embarrassment, inconvenience, or added work load to Brenda & my family, my staff, the citizens of Ward 4, City of Norfolk and the Norfolk PD. Like any other citizen, i will accept any consequences and will follow them, as I should be treated no different.

I will continue to work as hard as I can in any role to continue to make Norfolk the best for its citizens and businesses.
